We've written these Terms & Conditions to be as clear and straightforward as possible. We believe that a good business relationship is built on transparency — and that includes being honest about what you can expect from us and what we ask of you in return.

1. Who We Are

The Knowing Co is a division of At Your Instant Service Pty Ltd (ABN 74 064 646 699), based in Melbourne, Victoria, Australia. We help Australian businesses use practical A.I.-powered systems to respond faster, capture more opportunities and reduce pressure on their teams.

When we refer to "we", "us" or "our" in these Terms, we mean The Knowing Co and At Your Instant Service Pty Ltd.

2. Using Our Website

By visiting and using theknowingco.com.au, you agree to these Terms. If you don't agree, that's okay — but please don't use the site.

We ask that you use our website honestly and respectfully. You agree not to:

• Use the site for any unlawful purpose
• Attempt to damage, disrupt or gain unauthorised access to the site or its systems
• Copy, reproduce or distribute our content without our permission
• Misrepresent your identity or your connection to us

3. Our Services

The Knowing Co provides A.I.-powered business systems including A.I. voice reception, A.I. web chat, lead generation and follow-up systems, and client management tools. The specific services, inclusions and pricing for your engagement are set out in your service agreement with us.

We reserve the right to modify, improve or discontinue any service with reasonable notice to affected clients.

4. A.I. Systems — What You Need to Know

We want to be completely transparent about how our A.I. systems work and what your responsibilities are when you use them in your business.

What our A.I. systems do:

• Answer inbound phone calls on behalf of your business
• Engage with website visitors via chat
• Capture leads, answer questions and facilitate bookings
• Record and transcribe interactions for quality and service delivery purposes

Your responsibilities as a client:

• Disclosure: You are responsible for ensuring your customers are aware that A.I. systems may be used in your business. We strongly encourage clear disclosure.
• Call recording laws: Recording laws vary by state and territory in Australia. You are responsible for ensuring your use of our voice systems complies with applicable laws in your jurisdiction.
• Accuracy: You are responsible for ensuring the information we build into your A.I. systems is accurate and up to date.
• Oversight: You retain responsibility for your business and your customers. Our A.I. systems are designed to support you — not replace your judgment or oversight.

Automated Decision-Making: From 10 December 2026, Australian privacy law will require businesses to disclose the use of automated decision-making in their privacy policies. We will support our clients in meeting this obligation as part of our ongoing service.

5. Intellectual Property

All content on this website — including text, design, graphics, logos and the structure of our systems — belongs to The Knowing Co or our licensors. You may not copy, reproduce or use any of it without our written permission.

The systems and workflows we build for your business are customised for you. While the underlying technology and methodology remain our intellectual property, the content and configuration specific to your business is yours.

6. Payment and Fees

Fees for our services are set out in your service agreement. By engaging our services, you agree to pay the fees as outlined. Our standard terms are:

• A one-time setup fee is payable before work commences
• Monthly service fees are payable in advance
• We will provide reasonable notice of any fee changes
• Fees are non-refundable unless otherwise agreed in writing

7. Limitation of Liability

We work hard to deliver great results, but we want to be honest with you: A.I. systems are powerful tools, but they are not perfect. Results will vary depending on your business, your industry and how well the systems are configured and maintained.

To the extent permitted by Australian law, The Knowing Co is not liable for:

• Any indirect, incidental or consequential loss arising from the use of our services
• Loss of revenue or business opportunities
• Errors or inaccuracies in A.I. system responses
• Service interruptions due to third-party platform outages

Nothing in these Terms limits or excludes any rights you may have under the Australian Consumer Law.

8. Ending Our Relationship

We believe in earning your business every month. You may end your engagement with us by providing written notice in accordance with your service agreement.

We may end our engagement with you if you breach these Terms or your service agreement and fail to remedy the breach within a reasonable timeframe.

On termination, we will assist with a reasonable handover period and return any data that belongs to you.

9. Privacy

Your privacy matters to us. Please read our Privacy Policy — it explains in plain English how we collect, use and protect your information, and how we comply with Australian privacy law including recent 2024 and 2026 reforms.

10. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria, unless otherwise agreed.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the date at the top of this page. Continued use of our website or services after changes are posted means you accept the updated Terms.

We'll always try to give you reasonable notice of any significant changes.
